Or, to rephrase my title: 'Biters Bit their own Bums'. I am obliged to a couple of American legal swots writing in The National Review for this delicious example of how 'smartie-pants' American Democrat politicians thought they were being so clever when, back in Jimmy Carter's day ('Oh the horror, the horror!'), they increased the number of Federal Courts of Appeal by a third which they then packed full of Democrat supporting judges. Not satisfied with that, during the Bush Jnr. presidency, Sen. Chuck Schumer organised a wholesale campaign of filibustering in the Senate to block the appointment of any Bush appointees to the bench. Of course, as soon as 'Ol' Big Ears' became president, Schumer executed a pirouette and forced through a ban on filibustering judicial appointments in the Senate. The result is a preponderance of Democrat judges on the Federal Court of Appeals which is why so many of Trump's policies have been stymied.
However, now Schumer's not-so-clever device where-by the Senate can no longer filibuster Presidential appointments means that 'yuuuuuuge' numbers of Republican judges will be appointed. In addition, it has become clear that the number of Appeals Courts and their judges are insufficient for the workload and this provides Trump with the opportunity to increase their numbers and pack them full of Republican judges. So long as the Republicans can keep control of the Senate next year there is 's.f.a.' that Schumer and his stooges can do about it.
