Even stalwart Left-wing lynchpins of the MSM, like the NYT and the LA Times, are expressing their very real fears that the Supreme Court is going to strike down 'Obamacare' in its entirety. As I reported earlier, there is a view that if this happens, in effect, it will remove the "the albatross off his [Obama's] neck" and do more than anything else to help him be re-elected. Maybe, maybe not. But there is an even greater danger looming if the Supreme Court not only defies a Democrat Congress (as it was when this bill passed) but also breaks the habits of the last century during which a whole series of Congresses, with the benign assistance of a supine Supreme Court, has moved the socialist agenda further and yet further into American life. As Jonathan S. Tobin puts it in Commnetary:
For most of the last century, liberals have preached that the Constitution is a living document that needs to be interpreted and re-interpreted to fit the needs of the times. In the name of this legal faith they have championed a vast expansion of government power as well as the enumeration of various rights that are actually nowhere to be found in the actual text of the document. Generations of liberal activist judges have consistently thwarted the will of both the legislative and executive branches of government without a blush as they imposed their own ideas about every conceivable issue on the country. In doing so they changed the way we think about government and established its presence in our lives in ways that the founders would have thought unthinkable.
But today, "the times they are a'changin'" and by the slimmest of margins the balance has now tipped slightly to the conservatives, led intellectually, by Justice Clarence Thomas, a man deeply imbued with a belief in the wisdom of the Constitution against which all acts by the legislative or executive branches must be tested. Should the Supreme Court defy not only Democrat politicians in the Congress but also those in the White House, to say nothing of the mass of Left-wing liberal opinion in the media and in the country, then the backlash will be ferocious.
Already there are mutterings to the effect that in future the powers of the Supreme Court will have to be limited. America, wake up! - you'd better watch out!
